Terms of Service
1. Who we are
Brainmaxx ("the game") is operated by Breathe IT AS, Norway. By using it you agree to these terms. If you don't agree, please don't use it.
2. Brainmaxx is not an IQ test
This is the important one. Brainmaxx produces an entertainment estimate calculated from your performance on procedurally generated puzzles, presented on a scale that resembles the familiar IQ scale. It is not a clinical, diagnostic or professionally administered intelligence test, and a real IQ assessment requires a proctored test administered by a qualified professional.
Do not use your Brainmaxx rating for any educational, medical, employment or other consequential decision. We make no representation that it corresponds to any recognised measure of intelligence.
3. Your account and nickname
You must be 13 or older to create an account. You are responsible for keeping your login details secure and for activity under your account.
Nicknames are public. Choose something that is not offensive, does not impersonate another person or organisation, does not contain personal information about you or anyone else, and does not advertise. We may change or remove a nickname that breaks these rules.
4. Fair play
Ranked ladders and duels only mean something if results are real. You agree not to:
- use bots, scripts, automated solvers or modified clients
- tamper with saved data, network traffic or results to alter your rating
- create multiple accounts to inflate a rating or manipulate matchmaking
- exploit bugs rather than reporting them
- harass, abuse or deliberately disrupt other players
We may reset a rating, remove a leaderboard entry, or suspend or delete an account that breaks these rules. Where it's proportionate we will warn first.
5. Availability
The game is provided free of charge and as-is. We do not guarantee it will be available, uninterrupted or error-free, and we may change, suspend or discontinue any part of it. Progress stored only on your device can be lost if you clear your browser data — that is outside our control.
6. Intellectual property
The game, its code, design, puzzle generators and branding belong to Breathe IT AS. You may play it and share your results. You may not copy, resell, or create a competing service from it without written permission. Screenshots and share cards may be posted freely.
7. Liability
To the extent permitted by law, Breathe IT AS is not liable for indirect or consequential loss arising from your use of the game, including lost progress, lost data or decisions taken on the basis of a rating. Nothing here limits liability that cannot be limited by law, including for death, personal injury, or fraud.
8. Ending it
You may stop playing and delete your data at any time from the Profile screen. We may suspend or terminate access if these terms are broken.
9. Law
These terms are governed by Norwegian law, with the courts of Norway having jurisdiction. If you are a consumer, you keep the protections of the mandatory law of your country of residence.
10. Contact
Note: these terms are a considered draft covering how Brainmaxx actually works, but they have not been reviewed by a lawyer. Have a qualified adviser check them before you take real registrations.
